TERMS AND CONDITIONS
ONLINE STORE SALES
These terms and conditions apply to all online store sales made by Custom Products & Services, Inc. unless specific variations have been agreed to in writing and shall be binding upon Seller unless accepted by it in writing and signed by a duly authorized representative of the seller. All prior proposals, negotiations and representations, if any, are merged herein. By placing an order with Seller, Buyer will be deemed to have assented to all terms and conditions contained herein.
Custom Products & Services, Inc. reserves the right to alter its Terms & Conditions or sale without prior notice.
There may be certain orders that we are unable to accept and must cancel. Every effort will be extended to offer an alternative product to meet the customer’s requirements. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. For your convenience, you will be charged upon ordering and the order will be shipped within the time stated on the product specific page or mentioned under the shipping policies section of the website. There may be circumstances that require an order to be cancelled or the shipment delayed due to limitations of available inventory, shipping carrier delays, price inaccuracies, credit card processing issues or other conditions beyond our control. Credit will be issued in a timely manner to account for these conditions.
Unless expressly stated otherwise in a price quote of Seller invoice, all prices are as listed within the online store and subject to the terms, conditions and prices as listed. All prices are those in effect at time of shipment and are subject to change without notice.
All sales transactions initiated via the online store are processed via credit card only (Visa, Mastercard or American Express). Seller reserves the right to reject the Buyers order should the credit card transaction be denied during processing. No shipments will be released until the credit card transaction is complete and approved.
All products are warranted for 1 year from date of shipment against defects in materials or workmanship. Warranty does not cover issues relating to improper use, normal wear and tear abuse. All requests for warranty issues must by supplied to Seller in writing from Buyer within the warranty period.
Online orders that are accepted and in process may only be cancelled by contacting Custom Products & Services by phone (888-444-1202) or email: firstname.lastname@example.org prior to shipment. Orders cancelled after they have left our facility will require Buyer to return the items at Buyers expense. Once received in our facility, credit will issued less any applicable restocking fees.
Seller will make a good faith effort to complete delivery of products ordered within a reasonable period. Seller will provide Buyer with estimated ship dates and tracking information, when available. Seller assumes no responsibility or liability and will accept no backcharge for product lost or damage by the shipping carrier. All claims for damage must by initiated by Buyer directly to the shipping carrier. Seller should have no liability for Seller’s non-performance caused by acts of God, war, terrorism or any other cause beyond the Sellers control.
All content included on this site, such as text, graphics, logos, images and digital downloads is the property of Custom Products & Services, Inc or its content suppliers and protected by United States and International copyright laws. LIMITATION OF LIABILITY
To the greatest extent permitted by law, under no circumstances and in no event will Seller be liable for personal injury or property damage or any other loss, cost of repairs or incidental damage, punitive, special or consequential damages of any kind, whether based upon warranty, contract, strict liability, negligence of any other cause of action arising in connection with the design, manufacture, sale, transportation, installation, use or repair of the products sold by Seller. Buyer hereby acknowledges and agrees that under no circumstances, and in no event, shall Seller’s liability, if any, exceed the net sales price of the defective product(s); no additional allowance shall be made for the labor or expense of repairing or replacement.
